The case is going to the U.S. District Court of the Southern District of New York. This is a court with equal numbers of Republican and Democrat senior judges, but also with a vastly larger number of Democrat Article III judges. Depending on who hears the case, and whom is in the SEC's pocket... that itself may determine the outcome.
