>No, it was his first sale and he doesn't have anything else in store. Shady stuff..

The pieces certainly have more wear but don't look too horrible, the hallmarks are indeed quite nice. Since it was a new seller I assume he wasn't very organized and accidentally sent you a set that he hadn't listed for sale yet, maybe he had his wife pack it for shipment and she grabbed the wrong set. I think it was an honest error, but if you feel like it you definitely have grounds to request a discount. It looks like the set shown in the pictures may only have been monogrammed on the reverse of the handle with those small "NM" or WN" letters, and if they don't have monograms on the front side they would be more valuable to people who want to old silver to use. Since the set you got was in worse condition and if the set you thought you purchased wasn't monogrammed on the front then you have a good argument for either getting a partial refund, or arranging to buy the set you won at a discount. He may be very anxious to please you since he's a new seller and would have his reputation ruined by a bad feedback.

I won this batch the other day, not as old as your pre-revolution French stuff but it has a couple pieces of nice American coin silver which I've become quite fond of, I really like the babby mustard ladle spoons. I suspect it's around 120g of sterling and .900 coin silver, I paid $34.85 total (used more CC goypoints so only $14.85 out of pocket). Will report back upon arrival. Happy hunting down the antique cheapies frogfren.
